Terms of service

These terms apply when you use SpyTower: our website, our web app, our mobile app, and the website, phone number and messaging we run for your business. Using the service means you accept them.

What we provide

A website built and hosted for your business, a phone number that tells you about calls you missed and can text those callers back, requests for reviews from your customers, and a place to see the leads that come in. Exactly which of these you get depends on what you signed up for.

Your account

You are responsible for what happens under your account and for keeping your sign-in details to yourself. Tell us promptly if you think somebody else has access. You must be 18 or over and authorised to act for the business you are signing up.

What you are responsible for

The information you give us has to be accurate, because we publish it. That includes your licence numbers, the areas you serve, your hours and your services. We will not invent facts about your business, and we will refuse to publish a claim we cannot support.

Consent is yours. Every phone number you give us, or that reaches us through your website or your phone line, must belong to somebody who agreed to hear from you. You are responsible for that permission having genuinely been given. We record it, we honour STOP, and we will suspend messaging for any account where consent appears not to be real, because the carriers hold us responsible for it too.

Things we cannot promise

Carrier approval. Before any business may send text messages in the United States, the mobile carriers must approve it through a body called The Campaign Registry. We prepare and submit that registration, but the decision is not ours and we cannot guarantee it, nor how long it takes. If it is refused because information you gave us was wrong, correcting it and resubmitting may cost a further registration fee.

Search rankings. We build your site to be found, and we do not promise a position in any search result. Nobody honestly can.

Third parties. Parts of the service depend on Google, Twilio, Stripe and others. When one of them changes a rule or has an outage, it affects us too.

Domains and your website

Where we buy a domain for you, we buy it on your behalf and it is yours. If you leave, we will transfer it to you or to a registrar of your choosing at no charge. We will not hold a domain hostage.

The words and images on your site are yours to keep. The system that builds and runs it is ours. If you leave, we will give you a copy of your site's content, and the hosted site itself stops being served.

Paying

Fees are billed monthly in advance and are not refundable for a month already begun. Some costs are passed through at what they cost us, including domain registration and the carrier registration fees above; a domain, once bought, cannot be refunded by anybody. We will tell you before a price changes.

Ending it

You can cancel at any time and it takes effect at the end of the month you have paid for. We may suspend or end an account that breaks these terms, that uses the service to send messages people did not agree to receive, or that does not pay. Where we end it for anything other than misuse, we will give you reasonable notice.

Acceptable use

Do not use SpyTower to send anything unlawful, deceptive or harassing, to publish claims about your business that are not true, to attempt to reach another client's data, or to interfere with the service.

Liability

The service is provided as it is. To the extent the law allows, we are not liable for indirect or consequential losses, including lost profits or lost business, and our total liability for any claim is limited to what you paid us in the three months before it arose. Nothing here limits liability that cannot lawfully be limited.

Changes

We may update these terms. The date at the top changes when we do, and we will email clients before a material change takes effect. Continuing to use the service afterwards means you accept the new version.
